Also it can't possibly be a maximum of 12 points otherwise Newcastle would take 36 points over 3 years and just spend 5 billion now

The chance it's the same independent panel worries me.. then, the decision made after the seasons over? Would they then deduct points or carry them over? We look in trouble here

The difficult thing is that there's no higher court we can appeal to.
I think if there was any objective party ruling over this, like CAS, I would be quite confident the entire thing would get quashed, we'd get our 10 points back and this 2nd charge wouldn't even be upheld.
But we're appealing to the Prem, with the Prem's own ''independent'' panel. And last time we were heard by an ''independent'' panel, they decided to completely make up a new criteria for points deductions in the middle of the process, they magically came up with exactly the same points deduction that was suggested by Richard Masters a little while earlier, they have been leaking what they are going to do to the press before each charge (which credible court or panel does that btw?!) and they dismissed out of hand all of our perfectly logical, reasonable mitigation.
It's absolutely a stich up. They are changing the rules at the end of this season, so that this fucked up process can't apply to the richest teams and can't be scrutinised further. I think unless we get a long way clear of relegation, where we could afford to take say a 15 point hit with both charges and still stay up, we're in serious trouble and there's absolutely fuck all we can do about it. And in all honesty, nobody outside of us really gives a fuck about it, because it doesn't impact them.

Hate the PL as much as anybody but hate the people running our shit show just as much, incompetent and reckless in the transfer market since Moshiri came in, plenty sounded alarm bells on the shite we were buying and how we would get rid of such terrible signings, the Icelandic crab being the worst of them but plenty more, they were like kids who'd found a case full of money in a back alley.
Saying that the PL are the scum of the earth, they want us gone no doubt they won't rest until we go down the plug hole.

It’s hard for anyone to argue that there is a two tier system in place in the league even after the failed super league coup the punishments were tiny waiting until the end of the season to find out our punishment is awful for us and the other clubs involved

It's not that they want us gone. It's that we're being used as a pawn in their battle to avoid external regulation, for doing many of the same practices that other clubs have done (and doing less of it than a number of notable clubs), just before the rules change so that none of this would apply in 6 month's time.

I laugh at the thought of us being any sort of threat.
I think the only feasible theory is the premier league are scared of the regulator investigating the whole of the league and wanting to know why they allowed a criminal to fund us from the shadows.

Unfortunately we are just a pawn in the Premier Leagues battle against the Government. They want to continue to be able to do what they want, without the oversight of a Government body regulating them.

How to prove you're taking governance seriously? Apply unrealistic and draconian punishments to teams who don't have he financial muscle to fight in any major way, then once you've shown how seriously you take governance you quickly change the rules you've used to punish those teams so you don't have to apply the same to teams with pockets far deeper than your own.
